Canceling & Refunds
If J.D. Bruce is unable to complete a project, or the client suddenly request to stop the project, or a project hasn't been completed to the clients satisfaction, and all other options have been exhausted, the project code will not be provided to the client and all rights to the design will be therefore revoked; payment will not be required.
Once J.D. Bruce receives payment and the client has access to the full source code of any project, it can not refunded because J.D. Bruce can never be certain copies of the project haven't been made. All efforts will be made to ensure the client is informed and aware of exactly what they are purchasing.
Basic Payments
All payments made to J.D. Bruce will be made after the project has been completed, and after the client satisfied with the product. Once J.D. Bruce receives payment, the website website will go online and/or all source code and complete builds will be provided for any software solutions.
Milestone Payments
With some projects J.D. Bruce may require a milestone payment at the half way mark (this will be discussed before project commencement). If J.D. Bruce does not receive the arranged milestone payment he will have no choice but to stop work on the project. If the project is cancelled after J.D. Bruce receives a milestone payment, it will be fully refunded.
Code Ownership
The licenses typically provided with digital products made by J.D. bruce will give the buyer the right to modify, upgrade, and change the source code in any way you like. However, you do not have the authority to sell or trade any compiled or uncompiled code which I have written.
This includes any modified or upgraded versions of J.D. Bruce software. If you wish to market a modified version of a J.D. Bruce product, then you must obtain the appropriate permission. J.D. Bruce software is generally designed for single businesses and personal use only. You will have full control over the code, but not permission to sell J.D. Bruce code as if it were your own.
Of course, these copyright rules do not apply to projects where I have specifically agreed to hand over all code ownership to the client. These copyright rules mainly affect pre-made software packages that are available for instant purchase and instant download on the official web store.
Professional Indemnity
While J.D. Bruce will provide every effort to ensure any technical guidance/advice provided is correct, true, and high quality - there are times where the advice provided may result in unexpected consequences. Your agreement to these terms & conditions indicates your agreement with J.D. Bruce on the following conditions:
- you (the client) will not take any type of legal action should the information or directives provided by J.D. Bruce cause any type of damage to your business
- you (the client) fully understand the risk of acting on advice/guidance provided by J.D. Bruce and intend to handle the liabilities involved with potential failure
- you (the client) will not hold J.D. Bruce liable for businesses damages in any case where the information provided by J.D. Bruce causes damage to your business
- you (the client) will take all the necessary steps to reduce potential damages (eg. backup data) and you will make every effort to implement the advice correctly
Product Liability
While J.D. Bruce will provide products and services that do come with free technical support, it should be noted that J.D. bruce products come with no form of insurance or guarantee protecting the buyer from damaging technical failures or any other scenario where products created by J.D. Bruce cause business damages. Your agreement to these terms & conditions indicates your agreement with J.D. Bruce on the following conditions:
- you (the client) will not take any type of legal action should any software or code sold by J.D. Bruce cause any type of damage to your business
- you (the client) fully understand the risk of using software/code provided by J.D. Bruce and intend to handle the liabilities involved with potential failure
- you (the client) will not hold J.D. Bruce liable for businesses damages in any case where the information provided by J.D. Bruce causes damage to your business
- you (the client) will take all the necessary steps to reduce potential damages (eg. backup data) and you will make every effort to use the software correctly
